What is the citizenship of the baby who born on an airplane? 

Would he be considered a citizen of the destination where the flight is heading to or from where it is coming from? 

Does the baby consider a citizen of the country from where his parents belong? 

So, many questions, isn’t it?

Probably, no. 

However, the question is still there, what happens to the baby born on an airplane?

What is the Citizen of the Baby Born on an Airplane?

I’m sure, so far, this question does not pop up in your mind. However, it is essential to consider. So, here we go!

In India, a pregnant woman is not allowed to travel via airplane in her 7 or more months of pregnancy. However, in special cases, you can travel. Just so you know, always consider the same with your doctor before making any plans. 

Hope it will never happen, but what if you give birth to a baby on an airplane, say you are traveling to the USA from India.

The question that arises here is, what will be the citizenship of the newborn? What will be the birthplace of the baby in the birth certificate? 

Here, is the answer, 

If that’s the case with you, depending on the time of birth and border of the country above which airplane is flying is considered as the place of the baby’s birth. Therefore, you can obtain the birth certificate from the airport authority of the same country after landing. 

With that, your newborn has the right to remain a citizen of the country of his parents. 

In short, the choice is yours. 

For instance, if the airplane is flying to the USA from Pakistan and passing over India. And a baby born on an airplane. So he will be considered as a citizen of both countries, India and the USA. Additionally, the baby’s birthplace would be India. Although, India only has a single-citizenship provision.

Did it happen with anyone? 

Yes! It did happen in real life a few years ago in America. Here, what happened. 

An airplane flew from Amsterdam to the USA. Further, above the Atlantic Ocean, a woman got labor pain and gave birth to a healthy baby girl. Later, baby and mommy were taken to the Massachusetts General Hospital in the USA.

Therefore, as the girl was born above the border of the USA, so the birthplace of the baby is the USA. However, the baby got citizenship in both the USA and the Netherland.

Though, every country has different laws concerning citizenship of the baby born on the airplane.

Conclusion 

Hopefully, it will never happen to you. But if it does, you have to check out the laws of the country regarding the citizenship of the baby. Though, before traveling consult the same with your doctor.

According to me, you should avoid it, if possible.
